Permanent Residence available sooner and also to Subclass 482 visa holders sponsored in Short Term occupations

All subclass 482 visa holders to be eligible for permanent residence

Previously, subclass 482 visa holders sponsored in Short-Term occupations were not eligible to transition to permanent residence and were only able to renew their Subclass 482 visas a limited number of times.

However, the Government has just announced that ‘by the end of 2023’, all subclass 482 visa holders sponsored by Australian businesses will be eligible for permanent residency under the subclass 186 Temporary Residence Transition Scheme (“TRTS”) – not just those sponsored in Medium-Term occupations.

Also, the Government has announced these visa holders, like those sponsored in Medium-Term occupations, will be able to renew their Subclass 482 visas indefinitely - as long as they continue to meet the requirements.

3 year employment requirement reduced to 2 years

The period of employment required to achieve eligibility has been reduced from 3 years, to just 2 years.

Therefore, once a subclass 482 visa holder has worked for their employer, in their nominated position, on a 482 visa, for a period of 2 years, they should be eligible for permanent residency under the subclass 186 TRTS pathway.

This is great news which is welcomed by Integrate Legal after significant lobbying in the employer sponsored space.

We will advise as soon as we have confirmation in relation to the implementation date for these important and beneficial changes.
